ARTICLE 1: Scope of Application
1.1. These “Terms of Use”, abbreviated as “CGU,” establish the legal framework for providing the services of the e-shop https://www.carescence.com/ and their use by the “User.”
1.2. The Terms of Use must be accepted by any User wishing to access the site. They constitute the contract between the site and the User. Accessing the site signifies the User’s acceptance of these Terms of Use.
1.3. If the User does not accept these Terms of Use, they must refrain from accessing the services offered by the site.
Carescence reserves the right to unilaterally modify the content of these CGU at any time.
ARTICLE 2: Legal Information
2.1. The e-shop https://www.carescence.com/ is operated by SRL “D.C. Développements Cosmétiques,” abbreviated “D.C.,” registered with the BCE under number 0666.835.507, RPM Mons-Charleroi, Division Tournai, with its registered office at 8 Rue des Brasseurs, 7700 Mouscron, Belgium.
2.2. The Publication Director is Ms. Francine Rotsaert, also administrator of SRL “D.C.,” reachable at info@carescence.com.

ARTICLE 3: Definitions
This clause defines key terms of the contract:

User: Any person who uses the site or any of its services.

User Content: Data submitted by the User on the site.

Username and Password: Information necessary to identify a User on the site. The username and password allow the User to create a Customer Account and access member-only services. The password is confidential.
ARTICLE 4: Access to E-Shop Services
4.1. To place an order on the e-shop, the User must create a Customer Account.
Creating a Customer Account allows the User to enter a network code received from a Carescence network Seller to benefit from a 5% discount on purchases, and, if applicable, use a promo code.
4.2. To create a Customer Account, the User must complete the personal space form on the e-shop, providing all required fields (name, first name, address, phone, email, etc.). Information submitted must be accurate and truthful. The User is responsible for keeping their details up to date and may modify them by logging into their Customer Account.
4.3. To access Carescence e-shop services, the User must log in with their personal username and password. These credentials are strictly personal and must not be shared. The User is solely responsible for any misuse.
4.4. Deleting an account for any reason results in the complete deletion of all personal User information.
4.5. The website uses all available means to ensure quality access to its services. However, this is a best-effort obligation, and no guaranteed results are promised.
4.6. Events of force majeure that disrupt the website or server, or interruptions for maintenance, do not engage the liability of the Carescence e-shop. The User agrees not to claim compensation in such cases.

ARTICLE 5: Personal Data
5.1. In case of personal data collection, the site ensures processing in accordance with privacy regulations under EU Regulation 2016/679 of April 27, 2016, and Belgian law of July 30, 2018, regarding personal data protection.

ARTICLE 6: Intellectual Property
6.1. The name “Carescence” and the Carescence logo are registered trademarks (INPI – France & French Polynesia; OBPI – BENELUX) exclusively owned by SRL “D.C.” Any reproduction, use, or display of these trademarks without prior authorization is prohibited.
6.2. The e-shop website https://www.carescence.com/ is for personal use only. Commercial, speculative, or fraudulent uses are strictly forbidden. All website content—text, images, videos, software, databases, layouts, and other elements—are protected under intellectual property law. Access does not grant any rights, claims, or licenses.
6.3. Users must not use content illegally or allow others to do so. Any reproduction, partial or full, permanent or temporary, including framing techniques, without prior consent, constitutes infringement and may lead to civil or criminal penalties.
6.4. Users agree to use site content strictly for private purposes; commercial use is prohibited.
6.5. Any content uploaded by the User is their sole responsibility. Users must not post content that harms third parties; they bear responsibility for any legal claims. Content may be modified or deleted by the site at any time without prior notice.
ARTICLE 7: Liability
7.1. Information on the e-shop is considered reliable but may contain errors or omissions.
7.2. Information is provided for general guidance only and has no contractual value. The site is not responsible for administrative or legal changes after publication.

10.4. The site moderates publications and may refuse content without justification. Users may submit reviews online or via email.
10.5. Users retain intellectual property rights but grant the site a free, non-exclusive license to reproduce, adapt, distribute, and display content worldwide on any medium.
10.6. The site agrees to display the User’s name alongside each publication.
ARTICLE 11: Changes to the Contract
The site reserves the right to modify the clauses of this contract at any time.
ARTICLE 12: Duration
The contract is indefinite and takes effect upon the User’s first use of the service.
ARTICLE 13: Applicable Law and Jurisdiction
13.1. Belgian law governs this contract. If an amicable resolution fails, disputes are settled exclusively by the courts of Entreprise du Hainaut, Division Tournai, unless the User acts non-professionally, in which case jurisdiction follows Article 624 of the Belgian Judicial Code.
